Motion by plaintiff for reconsideration of order of Court dated February 19, 2003 dismissing plaintiff's action for delay--On October 3, 2002, Court allowed action to continue and established schedule which granted delay sought by plaintiff in his submissions on Status Review filed on August 22, 2002--Schedule gave parties nearly two months to file discoveries, two months for plaintiff to file and serve Requisition for Pre-trial Conference, and nearly three months for plaintiff to file an deserve Memorandum--Unfortunately fatal that plaintiff and counsel allowed all steps set out in October 3, 2002 order expire without attempting, in timely manner, to obtain variation of order by motion--Plaintiff's action dismissed for delay.
