Application for judicial review of inmate trust fund review committee (ITFRC) at Mission Institution refusing applicant's application to have funds withdrawn from inmate trust fund account to renew subscription to magazine "Scientific American"--Refusal based on Commissioner's Directive 090, s. 42 providing that normally purchases from other countries shall not be allowed, except with approval of institutional head--Applicant's subscription to magazine extended back to 1995--Application allowed--Scientific American educational publication--Applicant made appropriate request--Considering circumstances and purpose of federal correctional system enunciated in Corrections and Conditional Release Act, s. 3 (assisting rehabilitation) and related principle in s. 4(e) (offenders retain rights and privileges of all members of society, except those necessarily removed or restricted as consequence of sentence), based upon failure of ITFRC in conjunction with institutional head, to exercise jurisdiction conferred on it by Commissioner's Directive 090, s. 42, application should be allowed--Corrections and Conditional Release Act, S.C. 1992, c. 20, ss. 3, 4(e).
