Motion to amend notice of application under Federal Courts Rules, SOR/98-106, r. 75 in light of issuance by Health Canada of notice of compliance for perindopril erbumine to Apotex Inc. for their Apo-perindropril 8 mg tablets—Applicants in fact seeking to have two decisions reviewed, i.e. December 2005 decision Patented Medicines (Notice of Compliance) Regulations, SOR/93-133, s. 5 not applying to Apotex’ 8 mg tablets, February 2007 issuance of notice of compliance—These decisions not part of continuing course of conduct—Applicants must seek leave pursuant to Federal Courts Rules, r. 302 in order to proceed with review of two decision in one application—Motion denied.
