C-29, s. 5(1)(c) residency requirement not met—That decision second decision on this matter by Citizenship Court, first decision having been set aside by Rouleau J. of Federal Court (2005 FC 1511)—Because of Rouleau J.’s direction to apply Koo (Re), [1993] 1 F.C. 286 (T.D.) to application, not open to Citizenship Court to adopt one or both of other residency tests—Appeal allowed.
