Plaintiff (Édutile) small business preparing and selling price guides for used cars and trucks since 1994-Defendant Automobile Protection Association publishing and distributing own used automobile price guide since 1996 in conjunction with Toronto company-Association's guide, published in English only, including three categories of prices: Wholesale, Private and Retail-First issue whether Édutile's guide constituting original literary work entitled to protection of Copyright Act-If so, whether Association's work reproducing substantial part of Édutile's work, thereby infringing Édutile's copyright-Association must show Édutile's guides not constituting original literary work within meaning of Act, s. 5(1) and definition set out in s. 2-Édutile's work not original-Guide for Canadian consumers entitled "Évaluation des voitures neuves et d'occasion" already existing before Édutile's guide published-Furthermore, Édutile's three price columns already existing in "Canadian Red Book"-Even had Édutile's work constituted original literary work protected by Act, not substantially reproduced by Association-Not containing high degree of similarity required by judgments-Action dismissed-Copyright Act, R.S.C., 1985, c. C-42, ss. 2 (as am. by R.S.C., 1985 (4th Supp.), c. 10, s. 1; S.C. 1988, c. 65, s. 61; 1992, c. 1, s. 145(F)), 5(1).
