Between January 1 and March 1, 1994, defendants printed and distributed guide entitled The Magic World of Plants -- Medicinal Plant Guide-They also offered for sale and sold substances represented as being for use in treatment of diseases-They further offered prohibited products for sale in dosage form-After interim interlocutory injunction and interlocutory injunction, Denault J. issued a permanent injunction on December 20, 1993-Defendants knowingly violated terms of permanent injunction issued by Court by continuing to sell and offer to sell products covered by injunction-Defendant de l'Isle sentenced to one year in prison-Pharmavert Distribution Inc. fined $50,000 payable within thirty days of date of this order-Defendant de l'Isle shall also pay court costs fixed at $4,000 on a solicitor and client basis within the same time-Sentence of imprisonment reduced to six months on condition fine to be paid by company and court costs paid within time allowed-Food and Drugs Act, R.S.C., 1985, c. F-27, ss. 3, 9, 31-Food and Drugs Regulations, C.R.C., c. 870, ss. C.01.005 (as am. by SOR/81-248, s. 1), C.01.014 (as enacted idem, s. 2).
