Application to set aside Umpire's decision allowing appeal by respondent from Board of Referees' decision-Respondent, while receiving unemployment insurance benefits, opened small business-UIC claiming for overpayment of benefits of $7,000-Whether Board of Referees right in concluding respondent not unemployed under Unemployment Insurance Regulations, s. 43-Application dismissed (Létourneau J.A. dissenting)-Per MacGuigan J.A.: S. 43(2), as interpreted, requiring Board to take into account six factors in order to characterize nature of claimant's activity-Umpire correctly identifying error of law in Board's decision-Correct perspective one of proportionality rather than of absoluteness-Board fettering discretion in interpreting law-Per Létourneau J.A.
